The offering and the sale of products through our website (www.bustouteyewear.it) are monitored by the following Online Terms of Sale. The products purchased on the Website are sold by MAR.VAS S.R.L., located in Via Guantai Nuovi 30 – 80133 Napoli (NA), Partita IVA: 09095731213.
DEFINITIONS
The following definitions are used in this contract:
The Customer is any natural person who buys products for exclusively personal purposes.
MAR.VAS S.R.L. : means the company MAR.VAS S.R.L., located in Via Guantai Nuovi 30 – 80133 Napoli (NA), Partita IVA: 09095731213.
Products: means, generally, the products marketed by MAR.VAS S.R.L;
Part: indicates the Customer or MAR.VAS S.R.L. separately;
Parts: indicates Customer and MAR.VAS S.R.L together
GENERAL CONDITION OF SALE
Once the Customer confirms the purchase order, the conditions of sale and any other information contained on the website are fully acknowledged and accepted by the Customer.
The present Terms of sale may be updated or modified anytime by MAR.VAS S.R.L. which will notify any change through the relevant business channels.
SUBJECT OF THE CONTRACT
The offer and sale of products on the website www.bustouteyewear.it represent a distance sales contract governed by art. 50 ff. of the Legislative Decree 6 September 2005 (Consumer Code), as well as Legislative Decree no. 70 of 9 April 2003 (c.d. Law on Electronic Commerce).
The purchase of the products is reserved for private individuals.
ACCEPTANCE OF THE ORDER AND CONCLUSION OF THE CONTRACT OF A SALE
By sending your purchase order, the customer declares to have read and accepted these general conditions of contract and undertakes to observe them. The contract will be considered concluded, and will be binding for both parties, when the Order Confirmation will be sent to the user, by email to the email address indicated at the time of the order.
PRODUCTS AND SALES PRICES
All sales prices of the products indicated on www.bustouteyewear.it include VAT and any other tax and therefore are to be considered offers to the public pursuant to article 1336 of the Italian Civil Code.
It is hereby understood that any images accompanying the relevant product describing form could be not perfectly and completely representative of the relevant product's features, but it could differ for colour, dimensions, and ancillary products being included in the image.
PAYMENTS
At the time of purchase, the customer can choose to pay in advance by credit card, PayPal account, bank transfer or pay on delivery. In case of payment made with the PayPal website, the user is redirected on their pages, while in case of payment made with credit card , the user is redirected on the Stripe payment platform.
PayPal and Stripe platforms manage directly the data on their web site to pay. MAR.VAS S.R.L. does not collect any data relating to the credit card used or to "PayPal"/ “Stripe” payment method access codes. This information is collected directly by the payment system.
Payments shall be made by bank transfer within three (3) working days of placing the order, following the instructions provided on the website and automated emails.
The purchased goods will be sent to the customer only when payment has been credited to the recipient's account. The IBAN code to which to make the transfer can be the code IT35N0306903493100000005403, Banca di Credito Popolare, registered to MAR.VAS S.R.L. The purpose of the transfer must include the order number that will be communicated by email.
TAX CERTIFICATION AND INVOICE
Invoice for products purchased by private individuals is not issued because the sales operations are not subject to the obligation of tax certification pursuant to article 22(1) of Italian presidential decree no. 633/1972 and article 2 of Italian presidential decree no.2/1996. All customers are sent a summary of the order for fiscal and legal purposes.
TIMING AND METHODS OF DELIVERY
All orders are dispatched via express carrier, and delivery times vary depending on the destination, the time an order is placed and the availability of the product. The time of delivery, which will never exceed, in any case, those provided for by art. 6 D.Lgs. 185/99.
If all items are in stock, the order will be shipped within two (2) working days from the moment of sending the order confirmation.
Delivery times on national territory will be 1 working day from delivery to courier. For Puglia, Basilicata, Calabria, Sicily and Sardinia the delivery time will amount to 2-3 working days.
For hard to reach places such as mountain areas, small islands, extreme suburbs, delivery time will be equal to 3/4 working days.
Upon delivery, clients are asked to carefully inspect the package. A guarantee tape is applied to each package to prevent its opening and to signal, if the tape is damaged, any attempts to tamper.
In cases where the warranty tape is damaged, the Customer must immediately report the issue to the courier, accepting the package with a specific reservation indicating where and how the package was damaged. Otherwise the Product will be considered to be delivered regularly.
In the event that the recipient is not found, the Courier will leave a notice.
The second delivery attempt takes place the following day. If also in this case it is not possible to deliver the order, the customer must contact the courier as soon as possible to arrange delivery of the order, within maximum 2 working days. To enable delivery without hindrance, the customer will be asked to specify a mobile phone number in the delivery data
SHIPPING COSTS
For the shipment and packing of the order, it is not required to make any money contribution, in Italy.
HOW TO RETURN
For the purposes of and according to Consumers' Code, as amended by Legislative Decree no. n. 21/2014, the Customer is entitled to withdraw from the purchase, without any penalty and without having to state a reason, within 14 days from receipt of the goods. To request a return, the client must send an email to info@bustouteyewear.it ,within the time specified, and indicate: subject of the request (REFUND – SIZE CHANGE – ITEM CHANGE ), name, surname, address, order number and phone number.
As soon as this communication has been sent, the CUSTOMER must forward, at his own expense and using a courier of his choice, the product he intends to return, including a print of the email.

The product must be delivered to MAR.VAS S.R.L. within a maximum of 14 calendar days from the date on which the withdrawal was notified. Once the returned goods have been received, MAR.VAS S.R.L will proceed to:
REFUND: by bank transfer of the price paid for the product / the products for which the right of cancellation has been exercised, but the object of the withdrawal has been received by the company or unequivocal proof of shipment by courier has been provided. In this case you will have to indicate in the request to withdraw the bank details (IBAN and Account holder) on which we credit the sum.
CHANGE OF ITEM: Once we receive the item, we will immediately proceed to send the change without additional costs. In this case you will have to indicate in the request that you intend to proceed with the article change and the desired article.
SIZE CHANGE: Once we receive the item, we will immediately proceed to send the change without additional costs. In this case you will have to indicate in the request that you intend to proceed with the size change and the desired size.
In the event of a change in size or change of item, the availability of products may change upon receipt of the garment, we will provide to contact you via email.
The customer will be held liable, and therefore not refundable, if the damage observed was caused by bad or incorrect handling of the article. For products for personal use, for hygienic and sanitary purposes, products that have been used can not be returned.
All risks associated with the transport of the product made are the responsibility of the Customer.
Here is an example of the e-mail notification to be included in the package with which the returned product is shipped:
SUBJECT: Change of item
ORDER NUMBER: order number
BUYER DATA: Name, surname, address, order number and phone number
DESIRED ARTICLE: You have to specify which articles you want to receive.
IBAN CODE: Iban code where the customer wants to receive crediting
ACCOUNT HOLDER : the name on the bank account holder.
AWARDING AND PROCESSING OF PERSONAL DATA
The Customer's personal data is collected for the purpose of executing the purchase contract and the shipment of the orders received. These data are handled electronically in compliance with the law and can be disclosed only if requested by a Court of Justice or another authority enforced by law. Personal data will be communicated to subjects who are delegated to complete the necessary activities to execute the stipulated contract and these data will be released exclusively for this purpose.
The Customer expressly undertakes to provide to MAR.VAS S.R.L. copy of the identity documents deemed necessary in order to be verified. Failure to comply with this request authorizes MAR.VAS S.R.L to terminate immediately the contract for breach. The processing is carried out with the support of electronic means, in accordance with art. 11 of Legislative Decree no. 196 of 30 June 2003, giving to the user the guarantee and, in general, protecting his rights, fundamental freedom and dignity with particular reference to confidentiality and personal identity. Processing will take place for a period of time no longer than what is strictly necessary for the fulfillment of the purposes described above. The cancellation of personal data is subject to the sending of a written communication sent to MAR.VAS S.R.L. GOVERNING LAW AND JURISDICTION
The contract of sale between the Customer and MAR.VAS S.R.L is concluded in Italy and governed by Italian Law. Any dispute between the parties about this contract will be submitted to the Court of Naples.
